Terms and Conditions.
The terms covering use of this website, together with the general conditions on which we quote, supply, erect and warrant equipment. A written quotation or order acknowledgement always takes precedence over this page.
01About these terms
These terms govern your use of https://weldonengineers.tech, operated by Weldon Engineers (India). By using this website you accept them. If you do not accept them, please do not use the site.
Sections one to six concern the website itself. Sections seven onward set out the general commercial conditions on which we quote and supply. Where we issue a written quotation, purchase order acknowledgement or contract, the terms in that document take precedence over anything on this page.
02Information on this website
We take care to keep the technical information on this site accurate and current. It is published for general guidance and does not constitute engineering advice for any particular installation.
Capacities, dimensions, materials and performance figures are indicative. Actual performance depends on your heat load, water flow rate, temperature range, site wet bulb temperature and water chemistry. Nothing on this website should be relied upon in place of a written selection prepared for your specific duty.
03No offer or contract
Nothing on this website is an offer capable of acceptance, and no contract comes into existence through the site. Product pages, specifications and application notes are an invitation to enquire.
A binding agreement arises only when we issue a written quotation that you accept, or when we acknowledge your purchase order in writing.
04Intellectual property
All content on this website, including text, photographs, drawings, illustrations, layout and the POLO brand name, is owned by Weldon Engineers (India) or used with permission. ScaleOff is the property of its respective owner and is used here as an authorised distributor.
You may view, download and print pages for your own internal business use, such as preparing a specification or a tender. You may not republish, sell, or use our content commercially, and you may not present it as your own or remove any attribution from it.
05Acceptable use
When using this website you agree not to:
- Use it for any unlawful or fraudulent purpose
- Attempt to gain unauthorised access to the site or any server or system connected to it
- Introduce malware, or otherwise interfere with the operation of the site
- Submit false, misleading or third party contact details through the enquiry form
- Use automated systems to scrape or copy content beyond ordinary search engine indexing

We do not control and are not responsible for the content, availability or practices of any website we do not operate, and a link should not be read as an endorsement of everything on the linked site.
07Quotations and orders
Quotations are valid for the period stated on the quotation itself. Where no period is stated, a quotation is valid for thirty days from its date. Prices are subject to change after that period, and to change at any time where the scope, specification or site conditions differ from those on which the quotation was based.
Unless the quotation says otherwise, prices exclude Goods and Services Tax, freight, insurance, unloading, civil works, electrical supply, water supply and any statutory approval fee. Payment terms are those stated on the quotation.
An order is accepted only once we confirm it in writing. We reserve the right to decline an order, including where the specification requested would not perform as the client expects.
08Delivery and site work
Delivery periods quoted are estimates given in good faith and run from the date of a technically and commercially clear order. We are not liable for delay caused by circumstances beyond our reasonable control, including delayed site readiness, delayed approvals, transport disruption or force majeure events.
Where our scope includes erection or commissioning, the client is responsible for providing safe access, a completed foundation or basin to the agreed drawing, electrical supply, water for testing, and any statutory permit required for work on site. Standing time caused by the site not being ready is chargeable.
Risk in the goods passes on delivery to the site or to the carrier as stated on the quotation. Title passes on receipt of payment in full.
09Warranty
Equipment we manufacture is warranted against defects in material and workmanship for the period stated on the quotation or order acknowledgement. Bought out components such as motors, gearboxes and controls carry the warranty offered by their original manufacturer.
Wear parts including fill, drift eliminators, nozzles, drive belts and bearings are consumables and are not covered beyond any manufacturing defect apparent on delivery.
The warranty does not cover damage arising from incorrect installation by others, operation outside the design conditions, water chemistry materially different from that declared at the time of selection, lack of maintenance, unauthorised modification, or accidental and environmental damage.
Where a valid warranty claim is made, our obligation is limited to repairing or replacing the affected part, at our option. Claims must be notified promptly and before any remedial work is carried out by others.
10Limitation of liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, including loss of profit, loss of production, loss of contract or loss of data, arising from use of this website or from the supply of goods and services.
Our total liability in connection with any order is limited to the value of that order.
11Confidentiality
Technical information you share with us for the purpose of a selection, such as process data, water analyses and site drawings, is treated as confidential and used only to prepare and deliver your enquiry.
Equally, thermal selections, general arrangement drawings and calculations we issue are prepared for your project and remain our intellectual property. They should not be passed to a competing supplier for the purpose of obtaining a comparative price.
12Governing law and jurisdiction
These terms and any dispute arising from them or from any supply we make are governed by the laws of India. The courts at New Delhi, Delhi have exclusive jurisdiction.
Before commencing proceedings, both parties agree to attempt in good faith to resolve any dispute by discussion between senior representatives.
13Changes to these terms
We may revise these terms from time to time. The version in force is the one published on this page, and the revision date shown alongside this document is the date it took effect. Terms applying to an accepted order are those in force when the order was accepted.
